“We do not tag Congress with an extravagant preference for the opaque when the use of a clear adjective or noun would have worked nicely.”
– Gutierrez v. Ada, U.S. 250, 256
In the event a controversy arises involving the IRS ( tax audits ), Beneficiary rights, Will Contests, Breaches of a Fiduciary’s Duty, etc., Lawn & LeBlanc’s Vero Beach practice is able to intervene to remove fiduciaries and agents acting improperly, procure formal accountings and other required estate information, enforce compliance, ensure beneficiaries’ distributions and rights, and resolve IRS audits and challenges.
For example, our clients may consist of beneficiaries of a trust wishing to remedy improper actions which took place in an Estate or Trust. We also represent beneficiaries of a Trust who are not receiving the full accounting and information regarding the distribution of trust assets. Florida law mandates accountings and disclosure of trust transactions. We also represent clients before the IRS in the event of an individual, estate, or business audit or tax challenge. Due to applicable statutes of limitations, a beneficiary or taxpayer has a limited time to raise claims, object to possible improper handling of trust assets, respond to IRS notices, etc., and as such, time may be of the essence.
